Dear friends,

Freedom of movement is a basic right so many of us take for granted: we travel freely between our homes and places of work, running errands and visiting family along the way. We can travel abroad to attend a professional conference, or simply decide to take a spontaneous vacation.

But Palestinians cannot take any of these things for granted. Visiting family in Gaza during the holidays, traveling abroad for any reason, accessing their farmlands in the West Bank – all of these and more are often fraught with difficulties. HaMoked assists some 900 Palestinians each year to challenge denials of this right by Israel, succeeding in many of its cases, and advocates for wider policy changes.

Three recent examples illustrate the importance of HaMoked’s work in this area:

• The al-Atrash sisters who live in southern Israel requested permits to visit their brother in Gaza, who was about to undergo open-heart surgery. One sister’s request went unanswered; the requests of the two other sisters were rejected on the grounds that the brother’s condition was “not serious enough” according to the military. Only following HaMoked’s December petition to the High Court of Justice, did the military allow the three sisters to visit their brother who was still in hospital after surgery.
• In late December, HaMoked petitioned the Jerusalem District Court to allow a Palestinian man to travel to Jordan in order to undergo a specialized fertility procedure, unavailable in the West Bank. The man and his wife have been trying to start a family for years, and now pin their hopes on this unique procedure, other treatment options having failed. But Israel banned the man from leaving the West Bank on obscure “security” grounds. Following HaMoked’s petition, Israel removed the man’s travel ban and he traveled to Jordan.
• Even in East Jerusalem, Palestinians face a myriad of movement restrictions. In early January, HaMoked wrote to the Israel Police requesting the removal of a concrete roadblock from a major access road to the neighborhood of Isawiya, to allow free movement in and out of the neighborhood. The roadblock was placed some 19 years ago as a “temporary” security measure, and severely harms the residents’ daily routine and well-being. If this fails, HaMoked will turn to the High Court of Justice on the issue.

As these examples illustrate, freedom of movement is essential to realizing many other rights: the basic right to family life, to health, to education, to jobs and livelihood, and more. With the release of the Trump-Netanyahu annexation plan, this work is as crucial as ever. We remain steadfast in our commitment to universal human rights, which cannot be sacrificed or compromised. HaMoked will continue, both through individual assistance and through strategic litigation, to insist that these rights be respected.

זכות היסוד לחופש תנועה היא עניין מובן מאליו עבור רבים מאיתנו: אנו נוסעים בחופשיות בין הבית לעבודה, ובדרך ממלאים מטלות ומבקרים קרובי משפחה או חברים. אנו חופשיים לנסוע לכנס מקצועי בחו"ל או להחליט באופן ספונטני לצאת לחופשה. חלקנו מחליט להעתיק את מקום המגורים לשם קידום מקצועי או לימודים, או מהסיבה הפשוטה שאנו מעדיפים את אופיו של המקום החדש.  

עבור פלסטינים, אף אחד מהדברים האלה אינו מובן מאליו. ביקורים משפחתיים בעזה בחגים, נסיעה לחו"ל לכל מטרה שהיא, הגעה לחלקות חקלאיות בבעלות משפחתית בגדה המערבית – כל אלה ואחרים כרוכים לא פעם בקשיים שמציבה ישראל. המוקד מסייע לכ-900 פלסטינים מדי שנה לערער על שלילת זכות זו, עם שיעור הצלחות גבוה. המוקד גם פועל במישור העקרוני לקדם חופש תנועה של פלסטינים.

שלוש דוגמאות מהעת האחרונה מעידות על חשיבות עבודתו של המוקד בתחום זה:

• האחיות אל-אטרש המתגוררות בדרום ישראל, הגישו בקשות לבקר את אחיהן המתגורר בעזה, שעמד לעבור ניתוח לב פתוח. בקשתה של אחות אחת נותרה ללא מענה. בקשותיהן של שתי האחרות סורבו בטענה שמצבו של האח אינו חמור דיו על פי הקריטריונים הנוקשים שקבע הצבא לעניין כניסת ישראלים לעזה מטעמים הומניטאריים. רק בעקבות עתירתו הדחופה של המוקד לבג"ץ, שהוגשה בדצמבר 2019, התיר הצבא לשלוש האחיות לבקר את אחיהן שנותר באשפוז לאחר הניתוח הקשה שעבר.
• בשלהי דצמבר 2019, המוקד עתר לבית המשפט המחוזי בירושלים בדרישה שהצבא יתיר את יציאתו לירדן של פלסטיני לצורך קבלת טיפול פוריות מתקדם שאינו זמין בגדה המערבית. האיש ואשתו מנסים להקים משפחה זה שנים ומאחר ששיטות טיפול אחרות לא נשאו פרי, תקוותם כעת תלויה בטיפול ייחודי זה. ואולם, בעילה "ביטחונית" עלומה, מנעה ישראל מהאיש מלצאת מהגדה לירדן. בעקבות עתירת המוקד לבית המשפט, הסירה ישראל את מניעת היציאה לחו"ל שהוטלה על האיש, והוא נסע לירדן.
• גם בירושלים המזרחית, פלסטינים מתמודדים עם שלל הגבלות על תנועתם. במהלך חודש ינואר פנה המוקד למחוז ירושלים של משטרת ישראל בדרישה להסיר חסימת בטון מכביש גישה מרכזי של שכונת עיסוויה, כדי לאפשר תנועה חופשית אל השכונה וממנה. החסימה הוצבה במקום לפני כ-19 שנה כאמצעי ביטחון "זמני", ופוגעת קשות בשגרת חייהם ורווחתם של תושבי המקום. אם הדרישה לא תענה, יעתור המוקד לבג"ץ בעניין.

כפי שמדגימים מקרים אלה, חופש התנועה הינו הכרחי לצורך מימושן של זכויות רבות אחרות, בהן הזכות לחיי משפחה, לבריאות, להשכלה, לתעסוקה ופרנסה, ועוד. על רקע פרסומה של תוכנית הסיפוח מבית היוצר של טראמפ ונתניהו, המוקד מחויב כתמיד לערכי זכויות האדם האוניברסאליים, שלא ניתן להקריבם או להתפשר בעניינם. באמצעות סיוע פרטני בד בבד עם פעילות משפטית עקרונית, נמשיך לדרוש שזכויות אלה יכובדו ללא סייגים.
