Last month, Israel’s State Comptroller published a special report on the city of Jerusalem, with an extensive chapter devoted to the state’s deficient handling of the civil status of East Jerusalem Palestinians.  The report voices sharp criticism of the state’s conduct toward this population, which “harms, often in a very severe manner, the possibility to… fully realize their rights as permanent residents, and as people whose families lived in this land years before the State of Israel was established."

The report is a rare instance of an official body affirming the problems highlighted by HaMoked over the years. Specific issues cited by the report that are currently subject to HaMoked litigation include the intolerable conditions in the Ministry of Interior bureau in East Jerusalem, and the protracted processing time of requests for child registration and family unification.

The report notes that the state’s deficient conduct forces many East Jerusalem Palestinians to “turn to the courts to fulfill their rights”. The report also notes that ”in the absence of coherent government policy, the center of gravity for determining these issues has shifted in practice to the legal system.” The references for both these statements consist largely of cases filed by HaMoked.

In other words, the work of HaMoked – both the individual assistance and the strategic litigation to change policy – is crucial to ensure that East Jerusalem Palestinians enjoy their basic rights.

בחודש שעבר פרסם מבקר המדינה דו"ח ביקורת מיוחד העוסק בעיר ירושלים, הכולל פרק נרחב שכותרתו "טיפול המדינה במעמדם האזרחי של תושבי מזרח ירושלים". בדו"ח מובאת ביקורת נוקבת על התנהלותה הקלוקלת של ישראל כלפי תושבי ירושלים המזרחית, אשר "פוגעת, לעיתים באופן קשה ביותר, באפשרות[ם]... למצות את זכויותיהם כתושבי קבע, וכמי שמשפחותיהם התגוררו בארץ שנים לפני שהוקמה מדינת ישראל".

הדו"ח הינו דוגמא נדירה להכרתו של גוף רשמי בקיומן של הבעיות נגדן פועל המוקד זה שנים. נושאים בולטים שעולים בדו"ח מצויים כיום תחת ביקורת שיפוטית במסגרת הליכים שהגיש המוקד, לרבות התנאים הבלתי נסבלים שבלשכת משרד הפנים בירושלים המזרחית, והטיפול המתמשך עד בלי די בבקשות של תושבי העיר הפלסטינים לרישום ילדים ולאיחוד משפחות.

הדו"ח מציין, כי התנהלותה הפסולה של ישראל מאלצת פלסטינים רבים מירושלים המזרחית "לפנות לערכאות שיפוטיות כדי לממש את זכויותיהם". בנוסף, הדו"ח קובע כי "באין מדיניות ממשלתית כוללת, מרכז הכובד של ההכרעה בסוגיות האמורות היה, הלכה למעשה, בידי המערכת השיפוטית". שתי קביעות אלה מתבססות בעיקרן על הליכים משפטיים שהגיש המוקד.

זהו אישוש ברור לכך שעבודתו של המוקד, הן בסיוע הפרטני והן בפעילות משפטית לצורך שינוי מדיניות, הינה חיונית על מנת להבטיח את זכויותיהם הבסיסיות של פלסטינים מירושלים המזרחית.
